I contacted 3 lenders requesting for eligibility of refinancing my home. The lenders indicated that it would be possible with the exception Midland Mortgage Co. having reported my account in default for the last 12 months every month on my credit report. Back in February I had mentioned that I had disputed this with the credit companies. In attempts of getting this corrected Midland Mortgage Co. And South & Assoc. have caused me more damage than I had expected. Therefore I'm sure you are aware of the provisions in the Fair Debt Collection Practices Act (FDCPA), and I am requesting that Midland Mortgage Co. Correct this false information. To refresh Midland Mortgage Co. Memory on what constitutes legal validation; I gave them a list of the required documentation: • Complete payment history, the requirement of which has been established to prove that these payments were made 10-15 days in advance. I'm sure you know, under FDCPA Section 809 (b), Midland Mortgage Co. And South & Assoc P.C. are not allowed to pursue reporting an inaccurate debt if it is not validated. They should be made aware that in TWYLA BOATLEY, Plaintiff, vs. DIEM CORPORATION, No. CIV 03-0762 UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA, 2004, the courts ruled that reporting a collection account indeed is considered collection activity. Midland Mortgage Fraud for profit My loan was sold to Midland Mortgage and the nightmare began. Not only was I never Late with a payment they applied late charges to my account every month for the 18 months. I send my payment at least 10 days before my due date. But alas, Midland Mortgage Co. has a neat little "scam" of holding the payment until after the due date and charging me late fees. I figured this out and started having to "waste" my hard earned money sending the payment return registered mail receipt requested. Now my attorney is looking at everything. And no, I have not notified Midland Mortgage Co. that I have an attorney looking at their deceptive practices. They'll find out when it is revealed for the cons they are and I own my house. And let’s not even go there as to the disposition and attitude of their employees. Every time you talk to someone you get a different answer. I am not sure what their training is, or lack of, but it. But from what I can see is that they seem to hire people who have absolutely no people skills. They are given a card to read from and the only thing that can be said is “your loan is in default or foreclosure, and you have several options one is we can set you up on a repayment plan”. I have to go through 2 or more people just to get one answer, then call back to see if I will get the same answer again. Question: If you pay your payments before the due date, have over $1600 in a suspended account with money they do not know what to do with, and they foreclose on your house what chance are we being given? Midland will tell you they are trying to help you. I have heard lately in the media that banking is doing well on Wall Street, The housing market is has increased. But foreclosure has doubled and we have more repayment plans than Mortgage. I would guess that 8 out of 10 people in the United States are on a repayment plan or have filed bankrupt. So how are all of these people surviving? Midland Mortgage Co and Midfirst Bank have a plan and were not in it other than supplying them with your hard earnd money so they can live in their 1.2 million dollar houses and laugh, because they think you do not know. Is this the AMERICAN DREAM? If you have a way to do it, get your home mortgage away from Midland before they ruin your credit rating, treat you like crap, and pretend they are better than you! 1.Pay your payments 5-10 days prior to the due date if you can. 2.Make a copy of the check, Money order, before you send the payment. 3.Send your payment return registered receipt requested (Green Copy) 4.Note when you wrote the (check /money order) the month it is for, check number, account number, date it was cashed, and ask for verification when it was cashed. 5.If the check is sent back from Midland Mortgage Co. Send another same procedure. 6.Keep your own Payment Ledger, attach all the information and give it to your attorney he is not the bad guy. But the one who gets all the crap. If you follow this small list of items you, and your attorney can sleep good at night. .

Reader’s Please pay close attention, for what I am about to tell you is true. I have all the documentation as proof to what I am about to lay out so. You and your attorneys can put these people out where they belong. Exactly them where they put you. I have no legal background experience, but have done my home work. I would like to first address the Banks, Mortgage Co., Lenders, and prosecuting attorneys, FBI, Secret Service so called agents, that are provide false and misleading reports their organizations. These are about to catch up with you. And those who have indicated they are trying to resolve these criminal processes you full of crap. Your only looking for the same thins the scammers are, (A paycheck) this is a special announcement for the FBI agent in Kansas City, Mo. That I reported the incident to (I did a Google and found a lot of people with the same problem I am having. Now would you like to do your job)!! (predatory lenders/ Scammers) Reader’s U.S supreme Court Judges, Judges, and defense attorneys are getting frustrated with fact of having their courtroom packed with hardworking people that you are taking advantage of. Foreclosure, bankrupt, and unemployment are about 75% in the last 3 years and you caused it. In 2006 I filed Chapter 13 bankrupt because First Horizon wanted to be a part of that Mortgage Scam ring. I had several problems with First Horizon Mortgage that indicated the start of the mortgage scam. It first started out with two late payments, an increase in payment, and then an increase in escrow. From that point excessive double payments and misapplied payments indicating that payments were late. Than allegations that payments were not being received. That had started with First Horizon and continued over to Midland Mortgage and MidFirst Bank. I could write 15 pages of the Scams that these institutions have tried to use against me to include foreclosures 5 times on my house. But my point is it’s time for these Mortgage Scam, predatory lenders and illegal foreclosures scammers, Banks, Mortgage Co., Lenders, and prosecuting attorneys, FBI, Secret Service so called agents , that provide false and misleading reports their organizations about who they are trying help with you. And indicated they are trying to help the economy to resolve these criminal acts. .

my VA loan was sold to these clowns for servicing. I just had extensive roof / hail damage and got my insurance company check right away. midland wants me to endorse the check, send estimates and all this other paper work with it AND THEY WILL DECIDE WHO TO PAY AND WHEN. That is CRAP. Many people in my area have this damage and have new roofs already, without a hassle from their mortgage company. i can pay my own roofers etc. IDIOTS>.

Midland bought me fom another company and I have had the same hassles that others here have listed. The customer service consultants are rude, they are consistantly threatning foreclosure,the website never works and they raised my payment for no apparent reason!! If I could have had a choice I would never choose this company!!.

They bought out my mortgage from GMAC, told me everything was going to be transferred over that I had nothing to worry about. Then I was told that i was 30 days late on my mortgage and it was my fault. These people do not know what customer service is all they do is give you the run around.

Summary
This company bought my mortgage and is very low tech. They have a web site but nothing works on it. It is one of the reasons this country is in the shape it is in. The SEC should investergate NOW. There is something going on with company that is not clear. You get the feeling of bat and switch is about to occur. The people you talk to are not very informed and rude. They are not the kind of people you want do business with. The BBB and SEC should take a good look at this company. .
